Drafting contracts

Drafting contracts and specific contractual terms (for use across public construction contracts) to reflect Victorian government policies.

Ministerial Directions

We have extensive experience in advising on the Project Development and Construction Management Act 1994 and Ministerial Directions and construction contracts for various projects. We have previously participated in the Department of Treasury and Finance led multi-agency working party review of Ministerial Direction No 2 in 2016/7, and commented on the Draft Ministerial Directions in 2018.

Our knowledge of the legislative framework and the policy regime allows our team to meaningfully assist with legal documentation, drafting and reviewing for compliance in this area.

Tendering framework

We have a unique whole-of-government perspective and a strong understanding of government tendering and evaluation processes. We consider legal issues as they specifically relate to the commercial transactions for public construction projects.

We consider the need for variations to evaluation criteria based on the services or project procurement being considered.
