Duncan's practice includes litigation and advisory work in constitutional law and judicial review of administrative decision-making. He also advises on complex questions of statutory interpretation, executive and parliamentary powers and access to information. His clients include the Attorney-General, government departments, agencies and statutory authorities.

Duncan has conducted litigation in State courts and tribunals, and also in the High Court's appellate jurisdiction on behalf of the Attorney-General.

Duncan joined the VGSO in September 2021. He was previously an associate at a top tier commercial law firm. In that role, Duncan acted for clients in disputes, statutory adjudication, litigation and arbitration across the construction industry in Australia. He also regularly advised public sector clients on regulatory matters, including disciplinary action.

Prior to that, Duncan was an associate to a judge of the Supreme Court of Victoria.
