In its procurement the Victorian State Government is seeking to support its agencies in achieving the best value for government funds. VGSO has a detailed understanding of the legal and policy requirements that apply to government tendering and contracting, including the templates and guidelines issued by VGPB and Partnerships Victoria, DTF.
We advise on government probity requirements and the probity issues that may arise during the tender process.
We have extensive experience in advising, developing and negotiating end of contract arrangements with an existing supplier, including arrangements for transition to a new supplier. This is a high risk area for government, which is often overlooked when planning new procurement.
We work on a wide range of contracts, including alliance contracts, Partnerships Victoria contracts, funding and service agreements, and inter and intra government arrangements between governments and agencies.
When government outsources functions, such as the running of prisons and the operation of traffic cameras, it remains responsible for delivery of the service and compliance with legislative requirements, including management of privacy and some common law liability. We ensure these contracts manage government’s liability and responsibilities.
In addition to assisting with the development of contracts, we also advise on government’s rights during the contract, in the event that implementation or performance issues arise. Should disputes escalate, our expert litigation team can assist.
