Freedom of information & privacy
The VGSO assists agencies to navigate and fulfil their obligations under Freedom of Information (FOI) and Privacy laws. Our strategic approach focuses on efficient compliance, taking into account statutory and business functions, political sensitivities and public perceptions. In addition to providing advice, we also conduct VCAT reviews.
Privacy is a relatively recently codified area of law, under which often complex obligations have been imposed on agencies, pursuant to the Charter of Human Rights and Responsibilities. Our experts have extensive experience in the policy and practice of privacy law.
Recently the VGSO provided broad-based strategic advice to a newly created agency regarding highly sensitive information. The legal team had to balance the practical imperatives impacting the agency with the legal principles applicable to the various exemptions.
