Administrative law

We provide advice and guidance to government agencies to help them carry out their statutory functions. We advise on the exercise of powers and duties, procedural fairness, decision-making processes, delegations, summary prosecutions, and interpretation of empowering statutes.

Recently we advised a key government regulatory agency on the exercise of its investigative powers. In the instances where these were not comprehensively set out in the empowering statute, the branch advised on whether evidence could be obtained coercively, as well as the conduct of hearings in private.

We currently have lawyers seconded to a number of government departments. The additional knowledge gained from working in house enhances our level of assistance in helping the departments fulfill their statutory obligations. The work is diverse and includes FOI & privacy, whistleblowers, decision making and review processes, development of statutes and regulations, and the preparation of agreements of various types.
